These terms govern registration, subscriptions and authorized use of the SmartISPBD platform.This policy forms part of the agreement governing use of SMART ISP BD services.
1. Acceptance of these terms
By creating an account, purchasing a subscription or using SmartISPBD, you confirm that you are authorized to act for the relevant business and agree to these Terms & Conditions, our Privacy Policy and Refund & Return Policy.
If you do not agree, do not register for or use the service.
2. The service
SmartISPBD is a hosted ISP-management platform that may include billing, customer records, PPPoE, Hotspot, MikroTik integration, voucher management, reports, messaging and related tools. Features and limits depend on the subscribed package and configured integrations.
Router, payment, SMS, email and other third-party services remain subject to their providers, connectivity and credentials. Their availability is not fully controlled by SmartISPBD.
3. Registration and account responsibility
- Provide accurate registration, billing and business information and keep it current.
- Keep passwords, router API credentials, payment credentials and recovery channels confidential.
- Grant staff only the permissions they need and promptly remove access that is no longer authorized.
- You are responsible for activity performed through your account unless you promptly report and reasonably demonstrate unauthorized use.
4. Subscriptions, prices and renewal
Packages, prices, duration and included limits are shown before purchase or assignment. A subscription starts or renews only after the applicable payment or approved balance charge is verified.
Unless an explicit automatic-renewal arrangement is offered and accepted, you must renew before expiry. We may change future package pricing or features with reasonable notice; a change does not retroactively alter a paid current term.
5. Payment and taxes
You must use an authorized payment method and provide a valid payment reference. A payment shown as pending is not complete until server-side verification succeeds. You are responsible for applicable taxes, gateway fees or bank charges unless expressly included.
6. Acceptable use
You must not use SmartISPBD to:
- Break applicable law, infringe another person’s rights or process data without appropriate authority.
- Attempt unauthorized access, bypass subscription limits, probe security, distribute malware or disrupt the platform.
- Send unlawful or unsolicited bulk messages, falsify payment events or misuse connected routers and gateways.
- Copy, resell, reverse engineer or commercially exploit the platform except under a separate written agreement.
7. Customer data and backups
You retain responsibility for the legality, accuracy and use of data you enter or synchronize. You should maintain exports or backups appropriate to your business-continuity needs. We may maintain operational backups, but they are not a replacement for your own retention obligations.
8. Availability, maintenance and support
We aim to keep the service reliable but do not promise uninterrupted or error-free operation. Planned maintenance, emergency security work, internet failure, hosting failure, provider outage or router unavailability may temporarily affect features. Support is provided through the published channels and according to the applicable package.
9. Suspension and termination
We may restrict access for expiry, non-payment, security risk, abuse or material breach. Subscription restriction does not by itself delete customer or historical data. Where practical, we will provide notice and an opportunity to resolve the issue.
You may stop using the service at any time. Outstanding charges and provisions intended to survive termination remain effective.
10. Intellectual property
SmartISPBD software, interface, documentation, branding and related materials belong to MHM Soft IT Solutions or its licensors. Your subscription grants a limited, non-exclusive, non-transferable right to use the service during the active term.
11. Disclaimer and limitation
To the extent permitted by applicable law, the service is provided on an “as available” basis. We are not liable for indirect or consequential loss, lost profit, third-party provider failure, internet outage or actions taken through improperly secured credentials. Nothing in these terms excludes liability that cannot legally be excluded.
12. Changes, governing law and contact
We may update these terms when the service or legal requirements change. Material changes will be communicated reasonably. These terms are governed by the applicable laws of Bangladesh, subject to any mandatory consumer or commercial protections. Questions may be sent to the contact details below.
